ZitatSEATTLE-- No felony charges. That's the word on a repeat offender who was expected in court late Tuesday afternoon, but Francisco Calderon was a no show.
He's accused of assaulting a toddler over the weekend.
Calderon was busted just 48 hours after getting out of jail last week.
As of Tuesday morning Calderon, a habitual offender, was being held on investigation of assault of a child for allegedly throwing coffee on a toddler.
But in a last minute move - we learned - he's no longer facing a possible felony charge but being held on a misdemeanor.
That means this case goes from the King County Prosecutor's Office to the City Attorney’s Office.
Media waiting on his first court appearance Tuesday afternoon found out in court from pro tem Judge Annie Harper that Calderon would be a no show.
“Mr. Calderon is being released without conditions on the felony charge...he has been filed in Seattle Municipal Court on a misdemeanor charge...he remains detained but not on the felony, that is by decision of King County Prosecutor's Office and Seattle City Attorney,” Harper said.
We've reached out to the King County Prosecutor's Office asking for an explanation on why the change happened.
In an email, a spokesperson said the case ‘has been sent to municipal court.'
Calderon has 74 convictions including 15 assaults, according to court records.
