During the past few weeks the state of Massachusetts signaled a willingness to award temporary custody of Justina Pelletier to her parents so she could be transferred back to her home state of Connecticut. This is critically important not just because she belongs with her family and is being held captive against their will, but also so she can obtain medical care needed to improve her deteriorating health.
Unfortunately, a judge has ruled against Justina’s freedom and will continue controlling her life indefinitely.

The decision by Judge Joseph Johnston came in response to a motion, presented by the 15-year-old’s court-appointed lawyer and the lawyers for her parents, Linda and Lou Pelletier of West Hartford, Conn., which called for the parents to be awarded “conditional custody” of their daughter.
Details are still limited. What we do know is the judge has, to date, ignored the motion of the Pelletier family for temporary custody and instead chose to award permanent custody to the state.

UPDATE: The state has set a date of May 25th for the next date of decision. The state could set Justina Pelletier free two months from now, but the ruling allows the state more freedom in this decision. At least, this is currently the case as we understand it. We’ll update this with new information as it becomes available.
